Terms of Use

These Terms of Use govern your access to and use of the Ocean CRM platform, including our web dashboard and mobile application.

1. Acceptance of Terms

Welcome to Ocean CRM. By registering an account, installing the Ocean CRM mobile application, or using the web dashboard, you agree to be bound by these Terms of Use, our Privacy Policy, and any separate service agreement you have signed with Ocean Technolab.

If you are entering into these terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not agree to these terms, you must not access or use our services.

2. Eligibility & Account Security

To register for and maintain an active account on Ocean CRM, you must comply with the following requirements:

  • Eligibility: You must be at least 18 years of age or the legal age of majority in your jurisdiction to use Ocean CRM. The service is intended solely for business and professional use.
  • Account Registration: You must provide accurate, current, and complete information during registration and keep your account details up to date.
  • Security: You are responsible for safeguarding your password and account login credentials. You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use or breach of security. Ocean Technolab will not be liable for any loss or damage arising from your failure to maintain account security.

3. Subscriptions, Fees & Payments

Access to our premium CRM services is governed by billing terms and subscription agreements:

  • Subscription Models: Access to Ocean CRM features is provided on a subscription basis (monthly or annually) or under agreed custom plans.
  • Billing & Payments: Subscription fees are billed in advance. All payments are processed through secure third-party payment gateways (e.g., Stripe or Razorpay). By providing billing information, you authorize these payment processors to charge all subscription fees incurred.
  • Automatic Renewal: Unless canceled, subscriptions automatically renew for the same duration as the initial term. You can cancel your subscription at any time prior to the renewal date.
  • Refund Policy: Unless required by applicable law or explicitly stated in a custom agreement, all subscription fees are non-refundable.
  • Taxes: You are responsible for all applicable taxes (e.g., GST) associated with your subscription.

4. CRM Data & Intellectual Property

We respect your data rights and outline the ownership of content uploaded to the service below:

  • Your Data (CRM Records): You retain sole ownership of all customer/lead profiles, sales pipelines, documents, logs, and files uploaded, imported, or synced to your Ocean CRM account ("Client Data").
  • License to Host: You grant Ocean Technolab a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and process your Client Data solely for the purpose of providing the CRM service, debugging application issues, and responding to support requests.
  • Data Warranties: You represent and warrant that you have obtained all necessary consents, permissions, and rights to upload, sync, or process your lead data (including contact details of third parties) through Ocean CRM.
  • Our Intellectual Property: Ocean Technolab retains all right, title, and interest in and to the Ocean CRM platform, including its software, logos, trademarks, website design, UI/UX, and codebase. You may not copy, modify, distribute, or reverse-engineer any part of the service.

5. Acceptable Use & Restrictions

To ensure a safe and reliable system for all users, you agree not to use Ocean CRM to:

  • Violate any local, national, or international laws or regulations.
  • Send unsolicited commercial communications, spam, bulk marketing emails, or cold outreach in violation of applicable anti-spam laws (e.g., CAN-SPAM, GDPR, or Indian telecom regulations).
  • Upload, transmit, or store any content that is defamatory, obscene, infringing on third-party intellectual property, or otherwise unlawful.
  • Attempt to bypass, disable, or interfere with security features, API rate limits, or server stability.
  • Upload malicious code, viruses, trojans, or worms.

Violation of these restrictions may result in immediate suspension or termination of your account without refund.

6. Ocean CRM Mobile App & Permissions

The Ocean CRM mobile app requires certain permissions on your Android device to function correctly. By using the app, you acknowledge and agree that these permissions are utilized solely for user-initiated actions:

  • Contacts: Used only to let you import device contacts directly into your CRM lead list.
  • Storage/Photos: Used only to allow you to upload images (like business cards) or save/export documents from the platform.
  • Microphone: Used only to let you record and attach voice memos to lead records.
  • Notifications: Used to deliver task alerts, reminders, and activity updates.

You can enable or disable these permissions at any time through your device’s system settings.

7. Service Availability & Support

We strive to maintain high availability for Ocean CRM, but we do not guarantee 100% uninterrupted uptime:

  • Uptime: The service may be temporarily unavailable for scheduled maintenance, updates, or emergency repairs.
  • Data Backups: While we perform regular automated backups, you are encouraged to periodically export and back up your critical sales and lead databases using our built-in CSV/Excel export tools.
  • Support: Technical support is provided via email at support@oceantechnolab.com during standard business hours.

8. Account Termination & Data Deletion

How service terminations and user account deletions are managed:

  • Cancellation by User: You can cancel your subscription at any time. You can also permanently delete your individual user account and credentials by initiating the deletion request inside the mobile app settings, which will redirect you to the CRM website to complete the deletion.
  • Account Deletion Request: Web-based account deletion requests can be submitted by emailing support@oceantechnolab.com from your registered business address.
  • Data Retention Post-Termination: Upon the termination of your organization’s subscription, we will permanently delete all associated organization lead databases, files, pipelines, and logs from our active servers within 30 days. It is your responsibility to export your data before canceling your service.

9. Disclaimer of Warranties

Ocean CRM is provided on an 'as is' and 'as available' basis. Ocean Technolab makes no warranties, express or implied, regarding the service's reliability, accuracy, completeness, fitness for a particular purpose, or that the software will be completely error-free or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Ocean Technolab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business goodwill, or service interruption, arising out of or in connection with your use of Ocean CRM.

In no event shall our total liability exceed the total amount paid by you to Ocean Technolab for the CRM service in the twelve (12) months preceding the event giving rise to liability.

11. Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of India.

Any disputes, controversies, or claims arising out of or relating to these terms or your use of Ocean CRM shall be subject to the exclusive jurisdiction of the courts located in **Vadodara, Gujarat, India**.

12. Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of any material changes by posting the updated terms on our website and updating the 'Effective Date' at the top of this document. Your continued use of Ocean CRM after such changes take effect constitutes your acceptance of the new terms.
